1. Agreement to Terms
By accessing gunthersound.com, creating an account, or purchasing any product from Gunther Sound, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website or purchase our products.
These terms apply to all visitors, customers, videographers, content creators, and any other person who accesses or uses the Gunther Sound website or catalog in any way.
2. Who We Are
Gunther Sound is a music label and licensing platform operating at gunthersound.com. We create and license original musical works for use in weddings, films, content creation, commercial projects, and personal use. All songs in the Gunther Sound catalog are original works owned exclusively by Gunther Sound.

3. Our Products
Gunther Sound sells digital licenses granting customers the right to use our musical works within defined parameters. We do not sell ownership of our music except in the case of an Exclusive Buyout agreement. Purchasing a license means you are purchasing the right to use the song — not the song itself.
All products are delivered digitally. Physical products are not available.
4. License Tiers — What You Are Buying
4.1 Personal License
The Personal License grants the licensee a non-exclusive, non-transferable, perpetual right to use the licensed song for personal non-commercial purposes only. Permitted uses include your own wedding ceremony, personal social media posts that are not monetized, and personal video projects not intended for commercial distribution.
The Personal License does not permit use in client work, monetized content, commercial projects, paid advertising, or any project where the licensee receives financial compensation.
4.2 Creator License
The Creator License grants the licensee a non-exclusive, non-transferable, perpetual right to use the licensed song for commercial purposes across unlimited projects. Permitted uses include client wedding films, monetized YouTube content, podcast productions, social media advertising, professional presentations, corporate events, and independent film and digital video projects.
The Creator License does not permit broadcast television, national advertising campaigns, theatrical film distribution, or sync licensing for major studio productions. These uses require a separate agreement. Contact licensing@gunthersound.com for broadcast and sync inquiries.
4.3 Annual License
The Annual License grants the licensee the same commercial rights as the Creator License for a period of twelve months from the date of purchase. The license renews automatically on the anniversary of the purchase date unless cancelled before the renewal date. Upon expiry or cancellation, the licensee may no longer use the song in new projects. Work completed during the valid license period remains licensed.
4.4 Annual Pass
The Annual Pass grants the licensee the same commercial rights as the Creator License for every song currently in the Gunther Sound catalog, as well as every song added to the catalog during the subscription period, for a period of twelve months from the date of purchase. The Annual Pass renews automatically on the anniversary of the purchase date unless cancelled before the renewal date. The same expiry terms apply as the Annual License.
4.5 Exclusive Buyout
The Exclusive Buyout is a separate custom agreement negotiated directly with Gunther Sound. Upon completion of an Exclusive Buyout, full ownership and copyright of the specified musical work transfers to the buyer and the song is permanently removed from the Gunther Sound catalog. Exclusive Buyout terms are governed by the individual agreement signed at the time of the transaction, which supersedes these general Terms of Service for that specific transaction.
5. What You May Not Do
Regardless of the license tier purchased, the following are prohibited under all circumstances:
5.1 Resell, redistribute, sublicense, or transfer any Gunther Sound audio file or license to a third party.
5.2 Claim authorship, ownership, or copyright of any Gunther Sound musical work.
5.3 Register any Gunther Sound song with a performing rights organization, Content ID system, or any rights management platform as your own work.
5.4 Use any Gunther Sound song in content that promotes hate speech, violence, discrimination, illegal activity, or any content that is harmful, defamatory, or obscene.
5.5 Incorporate any Gunther Sound song into a new musical work, sample it, or alter it for redistribution as a new composition.
5.6 Use a Personal License for commercial purposes of any kind.
5.7 Share download links or audio files with any person who has not purchased their own license.
5.8 Use any Gunther Sound song after an Annual License or Annual Pass has expired for new projects initiated after the expiry date.
Violation of any of these terms constitutes a breach of this agreement and may result in legal action, termination of your license, and a claim for damages.
6. Intellectual Property
All musical works, lyrics, production materials, branding, website content, and catalog materials are the exclusive intellectual property of Gunther Sound. All rights are reserved.
Your purchase of a license grants you specific usage rights as defined in Section 4. It does not transfer any intellectual property rights to you. Gunther Sound retains full copyright ownership of all musical works at all times, except in the case of a completed Exclusive Buyout.
You may not use the Gunther Sound name, logo, or branding in any way that implies endorsement, partnership, or ownership without our prior written consent.
7. Payment & Pricing
7.1 All prices are listed in United States Dollars unless otherwise stated.
7.2 Payment is processed securely through Stripe or PayPal. Gunther Sound does not store your payment information.
7.3 All sales are subject to applicable taxes based on your location.
7.4 Prices are subject to change at any time. Price changes do not affect licenses already purchased.
7.5 Subscription products — the Annual License and Annual Pass — are billed automatically on the anniversary of the original purchase date. You will receive a reminder before renewal. It is your responsibility to cancel before the renewal date if you do not wish to continue.
7.6 Promotional pricing and discount codes are valid only for the period specified and may not be combined with other offers unless stated.
8. Refunds & Cancellations
Refund and cancellation terms are governed by our Return & Refund Policy, which is incorporated into these Terms of Service by reference. Please review that policy before purchasing.
The short version: all sales are final once digital files have been downloaded. We handle genuine delivery failures, duplicate charges, and corrupted files promptly and fairly. Subscription cancellations take effect at the end of the current billing period.
9. Delivery of Digital Products
Digital files are delivered via download link immediately after purchase confirmation. It is your responsibility to download and store your files. Gunther Sound is not responsible for files lost due to device failure, accidental deletion, or expired download links.
If you experience any delivery issue contact support@gunthersound.com within 30 days of purchase and we will resend your files.
10. Accounts
If you create an account on gunthersound.com you are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Gunther Sound is not liable for any loss or damage resulting from unauthorized access to your account.
You may not create accounts for the purpose of circumventing licensing requirements or obtaining multiple copies of the same product fraudulently.
11. User Conduct
By using gunthersound.com you agree not to:
Use the website for any unlawful purpose or in violation of any applicable law or regulation. Attempt to gain unauthorized access to any part of the website or its systems. Interfere with or disrupt the operation of the website. Scrape, copy, or reproduce any part of the website or catalog without written permission. Misrepresent your identity or affiliation in any communication with Gunther Sound.
12. Disclaimer of Warranties
Gunther Sound provides its products and website on an as-is and as-available basis. We make no warranties, express or implied, regarding the uninterrupted availability of the website, the fitness of our products for any particular purpose beyond the uses described in these terms, or any outcome resulting from the use of our music in your projects.
We do not warrant that our website will be free from errors, viruses, or other harmful components, though we take reasonable steps to ensure security.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Gunther Sound shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website, including but not limited to lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Gunther Sound and its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses — including reasonable legal fees — arising from your use of our products in violation of these terms, your violation of any applicable law, or your infringement of any third-party rights.
15. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of Gunther Sound products shall be resolved through binding arbitration or in the courts of competent jurisdiction, at Gunther Sound's election.
16. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of gunthersound.com after changes are posted constitutes your acceptance of the revised terms.
We will not apply changes retroactively to licenses already purchased under previous terms.
17. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms of Service, together with our Return & Refund Policy and any individual license agreements, constitute the entire agreement between you and Gunther Sound regarding your use of our products and website. They supersede all prior communications, representations, or agreements on this subject.
